This information is provided pursuant to Article 37 of Egyptian Consumer Protection Law No. 181 of 2018, which requires suppliers in remote/e-commerce contracts to disclose their identity before a contract is concluded.
2. Acceptance of these Terms
These Terms of Service ("Terms") form a binding agreement between you and SAFWA STAR S&S LTD ("SharmBeat", "we", "us") governing your access to and use of the SharmBeat mobile application and the sharmbeat.com website (together, the "Service"). By creating an account, browsing, booking, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
3. Definitions
- "Business" / "Owner" — an entity or individual that lists a service, venue, excursion, property or activity on SharmBeat.
- "Content" — text, photos, reviews, messages, listings and any other material submitted to the Service.
- "Booking" — a reservation or request made through the Service between a user and a Business.
- "User" / "you" — anyone who accesses or uses the Service, whether as a visitor, resident or Business.
4. Eligibility & accounts
To create an account you must be at least 18 years old and have the legal capacity to enter into a binding contract under the law applicable to you (for users subject to Egyptian law, this may require you to have reached the age of full civil capacity under the Egyptian Civil Code, currently 21). If you do not yet have full contractual capacity, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use. You must provide accurate, current information when registering and keep it up to date.
5. Description of the Service
SharmBeat is a discovery, community and booking-facilitation platform for Sharm El Sheikh: restaurants, beaches, excursions, nightlife, events, real estate leads, services and a community layer for residents. SharmBeat is an intermediary. We connect users with independent, third-party Businesses; we are not the operator of the restaurants, excursions, beach clubs, properties or other services listed, and we are not a party to the contract formed between you and a Business when you make a Booking, unless expressly stated otherwise for a specific offer.
6. Bookings & payments
- Prices, availability, cancellation policies and the terms of the underlying service are set by the Business, not by SharmBeat, unless stated otherwise.
- Where in-app payment is available, payments are processed securely by our licensed Egyptian payment partner, Paymob. SharmBeat does not store your full card details.
- Refunds and cancellations for a Booking are governed by the individual Business's policy, disclosed at the time of Booking, subject to any mandatory rights you have under Egyptian Consumer Protection Law No. 181 of 2018.
- SharmBeat is not responsible for the quality, safety, legality, or availability of any service or property offered by a Business, nor for a Business's failure to honor a Booking. Disputes about the underlying service are between you and the Business; we may assist in good faith but are not obligated to resolve them.
7. User content & reviews
You retain ownership of the Content you submit. By posting Content, you grant SharmBeat a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display and distribute it within the Service for the purpose of operating and promoting SharmBeat.
Reviews must reflect a genuine visit or interaction with the Business being reviewed. We may remove Content, or restrict an account, that we determine in good faith is fake, defamatory, abusive, discriminatory, infringing, or otherwise violates these Terms or applicable law, including the Egyptian Anti-Cybercrime Law No. 175 of 2018.
8. Business / owner listings
Businesses are responsible for the accuracy of their listing information, pricing, availability and compliance with all licenses and permits required to operate in Egypt. Claiming a business profile requires verification; SharmBeat may reject or remove a claim it believes to be fraudulent. Paid plans (e.g., Premium, Business tiers) provide enhanced visibility and tools as described in the app; they do not create an employment, agency, partnership or joint-venture relationship between SharmBeat and the Business.
9. Prohibited conduct
You agree not to: (a) violate any applicable law or these Terms; (b) post false, misleading, defamatory or infringing Content; (c) impersonate any person or entity; (d) harvest or scrape data from the Service; (e) interfere with or disrupt the Service's operation or security; (f) use the Service for fraud, harassment, or to solicit unlawful activity; (g) circumvent booking or payment flows to avoid applicable fees.
10. Intellectual property
The SharmBeat name, logo, app and website design, and underlying software are the property of SAFWA STAR S&S LTD or its licensors and are protected by Egyptian and international intellectual property law. Except for the license you grant us over your Content, nothing in these Terms transfers any intellectual property right to you.
11. Third-party services
The Service integrates third-party providers, including Supabase (data hosting), Google Maps (mapping), Google Firebase (notifications), Sentry (crash monitoring) and Paymob (payments). Your use of features relying on these providers is also subject to their own terms, where applicable. We are not responsible for the acts or omissions of independent third-party providers or listed Businesses.
12. Privacy
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by Egyptian law, SharmBeat disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings are accurate, complete, or continuously available, or that the Service will be uninterrupted or error-free.
14. Limitation of liability
To the fullest extent permitted by applicable law, SharmBeat's aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount of fees, if any, you paid to SharmBeat directly (excluding amounts paid to Businesses) in the 12 months preceding the claim, or (b) EGP 1,000. SharmBeat is not liable for indirect, incidental, special, consequential or punitive damages, or for any act, omission, injury, loss or damage caused by a Business or another user. Nothing in these Terms limits liability that cannot be limited under mandatory Egyptian law, including in cases of fraud or willful misconduct.
15. Indemnification
You agree to indemnify and hold SharmBeat harmless from claims, damages, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your Content, or your violation of applicable law or third-party rights.
16. Suspension & termination
You may stop using the Service and delete your account at any time from the app. We may suspend or terminate your account if we reasonably believe you have violated these Terms, applicable law, or created risk or legal exposure for SharmBeat or other users. Where practicable, we will provide notice of the reason. Provisions that by their nature should survive termination (e.g., Sections 9, 10, 13, 14, 15, 18) will survive.
17. Complaints & dispute resolution
If you have a complaint, please contact us first at [email protected] so we can try to resolve it directly. As an Egyptian consumer, you also retain the right to file a complaint with the Egyptian Consumer Protection Agency (CPA) under Law No. 181 of 2018.
18. Governing law & jurisdiction
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights you may have to bring proceedings in your place of residence, the competent courts of Cairo, Egypt shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
19. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date and, for material changes, provide notice through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
20. Miscellaneous
- Severability: if any provision is found unenforceable, the remaining provisions remain in full effect.
- Force majeure: we are not liable for delay or failure to perform due to causes beyond our reasonable control.
- Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and SharmBeat regarding the Service.
- Assignment: we may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your rights without our consent.
- No waiver: our failure to enforce a provision is not a waiver of our right to do so later.
